PART III PREVENTION OF BUSH FIRES
SECTION 18 – COMMENCEMENT OF RESTRICTED BURNING TIME
(URBAN-RURAL ZONE)
Pursuant to Section 18 of the Bush Fires Act 1954, the Shire of Esperance advises that the Restricted Burning Period applies from Tuesday, 10 March 2026 until midnight Thursday, 30 April 2026 for the following zone:
URBAN-RURAL ZONE – includes fire zone: Urban-Rural (Esperance and surrounding rural residential areas).
Landowners/Occupiers within the Urban-Rural Zone MUST obtain a Permit to Burn from their nearest Fire Control Officer prior to undertaking any hazard reduction or burning activities.
The Shire's Chief Bush Fire Control Officer, Mr Phil Longmire, has exercised his powers to restrict the issuing of Fire Permits to the following conditions:
- Permits will not be issued for the burning of tree piles,
- A Permit to Burn may be issued for a maximum period of four (4) calendar days,
- A minimum of 400 litres of water must be available on site during the burn,
- Except for agricultural purposes, burning may only occur after 1500 hours and must be completely extinguished by 2359 hours the same day,
- Permit holders must adhere to all other conditions prescribed by the issuing Fire Control Officer; and,
- Permit holders must log their burns with the DFES Communications on (08) 9395 9209 prior to ignition.
All permits will be deemed invalid when the Fire Danger Rating reaches ‘HIGH’ or above.
Permit holders must check the Bureau of Meteorology website for the Fire Danger Rating and Emergency WA (www.emergency.wa.gov.au) for warnings or Total Fire Bans before burning.
Failure to comply with the above conditions may result in a $250 infringement under Regulation 15B(1) of the Bush Fires Regulations 1954. If a fire escapes the permitted conditions, the Shire reserves the right to recoup costs up to $10,000 under Section 18 of the Bush Fires Act 1954.
Fire Permits may be suspended or cancelled at any time by a Fire Control Officer based on local or forecast weather conditions. All fires must be fully extinguished by midnight on the day of permit suspension or cancellation.
