Bush Fires Act 1954
Part III Prevention of Bush Fires
Section 18 – Commencement of Unrestricted Burning Time (Urban-Rural Zone)
Pursuant to Section 18 Bush Fires Act 1954 the Shire of Esperance advises the Urban Rural Zone will commence its Unrestricted Burning Time (Open Burning) as of Saturday, 26 April 2025.
Urban Rural Zone – Includes fire zone: Urban Rural (Esperance & surrounding rural residential areas).
From this date, landowner and occupiers within the Urban-Rural zone are no longer required to obtain a permit to burn. However, all burns must still comply with the following minimum conditions:
- A firebreak of at least 3 metres wide must be in place around the burn area; and
- You must have either a hose connected to a reliable water supply that reaches the burn area or a functional firefighting unit with a minimum of 400 litres of water; and
- Weather conditions must be carefully monitored to ensure that smoke does not impact road visibility or cause a nuisance to neighbours; and,
- Neighbours directly adjacent to the property must be notified prior to ignition; and,
- All burns must be registered with the DFES Communication Centre on 1800 198 140 (Free call) before ignition.
Landowner/occupiers are reminded not to light any fire, unless you are fully prepared to take responsibility for it. Landowner/occupiers are responsible for any fire on their property until it's fully extinguished, this includes the smoke that may impact the visibility of road networks.
Fire Control Officers have the authority under Bush Fires Act 1954 to instruct request Landowner/occupiers to extinguish any fire deemed unsafe, at the risk of escaping, or to stop the lighting of fire during the unrestricted burning period.
