Proposed Health Amendment Local Law Open for Comment

Local laws are rules made by councils to guide how people and businesses operate within the community. They help maintain a safe and healthy environment and set clear standards that reflect community expectations.

At the November Ordinary Council Meeting, Council endorsed proposed amendments needed for the Health Amendment Local Law.

The amendment:

  • Aims to strengthen the Shire of Esperance’s ability to manage public health effectively.

The effect will:

  • Help to protect health, prevent disease, improve safety and promote wellbeing across the district.

Local Laws work alongside State legislation (Acts of Parliament) to manage day-to-day matters that affect the community. They also assist in resolving disputes and support good governance. Under the Local Government Act 1995, councils must review all local laws every 8 years.

The Health Amendment Local Law is open for public comment.

The Health Local Law 2025 was adopted by Council in August 2025 and gazetted on 15 September 2025. Following review by the State’s Joint Standing Committee on Delegated Legislation (Committee), the Shire has been asked to make specific amendments. These changes, or amendments, must follow the formal law-making process again. 

As such, the proposed amendments to the Health Local Law 2025 are;

  • Clause 5.12

In clause 5.12(2)(d) delete the reference to 11.37 and replace it with 11.4.

  • Schedule 1

In Schedule 1 Item 6 –

  1. Delete the reference to 7.9 and replace it with 7.11;
  2. Delete ‘relevant code’ and replace it with ‘Environmental Code of Practice for Poultry Farms in Western Australia 2024’.
