BUSH FIRES ACT 1954
PART Ill PREVENTION OF BUSH FIRES
SECTION 18 - RESTRICTED BURNING TIME
(RURAL ZONE - FIRE PERMIT RESTRICTIONS)
Pursuant to Section 18 Bush Fires Act 1954 the Shire of Esperance will be amending Restricted Burning Time conditions for the Rural Zone only, allowing fire permits to be issued;
RURAL ZONE - includes fire zones: West 1, West 2, West Coast 1, West Coast 2, North 1, North 2, East Coast 1, East Coast 2, East 1 and East 2.
From Monday, 10 March 2025 Landowner/occupiers MUST obtain a fire permit from their nearest Fire Control Officer before any Hazard Reduction or burning off can commence.
The Shire's Chief Bush Fire Control Officer, Mr Phil Longmire has exercised his powers to restrict the issuing of Fire Permits to the following criteria;
- Fire Permits will only be issued for Agricultural purposes;
- No Fire Permits will be issued for burning of tree piles; and,
- Fire Permits will be issued for a maximum 4 calendar days; and,
- A minimum of 2,000It of fire fighting water must be available at permit location; and,
- A minimum of 20,000It of firefighting water must be available at farm location; and,
- Permit Holders must adhere to all other conditions prescribed by the issuing Fire Control Officer or Fire Weather Officer; and
- Permit holders must log their burns with the DFES Communications Centre Ph: 1800 198 140 (Free call) prior to igniting.
All permits will be deemed invalid when the Fire Danger Rating reaches 'HIGH' or above. The permit holder is responsible for checking the Bureau of Meteorology website for the day’s fire danger rating before burning.
Due to exceptionally dry seasonal conditions, failure to comply with the above conditions may result in a $250.00 infringement under r75B(1) Bush Fires Regulations 1954. lf a fire escapes the permitted conditions, the Shire reserves the right to recoup costs up to $10,000.00 under s18(11) Bush Fires Act 1954.
Please note: Fire Permits may be suspended or cancelled at any time by any Fire Control Officer based on local or forecasted weather conditions. All fires will be required to be fully extinguished by midnight of the day of permit suspension/cancellation.

SECTION 17 — EXTENSION OF PROHIBITED BURNING TIME
(URBAN-RURAL ZONE)
Pursuant to Section 17 Bush Fires Act 1954 the Shire of Esperance advises it will be extending its Prohibited Burning Time (PBT) for the following zone and periods;
Prohibited Burning will be extended by twenty-one (21) calendar days for the Urban-Rural Zone to now conclude midnight Monday, 31 March 2025.
The Urban-Rural Zone includes fire zone:
Urban-Rural (Esperance & surrounding rural residential areas)
This is due to dry seasonal conditions and lack of any summer rainfall. This means;
- NO fires are to be lit in the open air during this period, and
- NO fire permits will be issued by Fire Control Officers.
This decision will be reviewed at that date having regard for the seasonal conditions applicable at that time.

SECTION 17 – EXTENSION OF PROHIBITED BURNING TIME
(RURAL ZONE)
Pursuant to Section 17 Bush Fires Act 1954 the Shire of Esperance advises it will be extending its Prohibited Burning Time (PBT) for the following zones and periods;
Prohibited Burning will be extended by fourteen (14) calendar days for the
Rural Zone to now conclude midnight Monday, 17 February 2025.
(The Rural Zone includes fire zones: West 1, West 2, West Coast 1, West Coast 2, North 1, North 2, East Coast 1, East Coast 2, East 1 and East 2)
This is due to dry seasonal conditions and lack of any summer rainfall. This means;
- NO fires are to be lit in the open air during this period, and
- NO fire permits will be issued by Fire Control Officers.
This decision will be reviewed at that date having regard for the seasonal conditions applicable at that time.

SECTION 17 - COMMENCEMENT OF PROHIBITED BURNING TIME
Pursuant to Section 17 Bush Fires Act 1954 the Shire of Esperance advises it will bring forward the commencement of Prohibited Burning Time (PBT) Shire wide;
Prohibited Burning will commence from:
Midnight Thursday, 7 November 2024.
This is due to seasonal conditions and means;
- Any active fires to be fully EXTINGUISHED by 6pm, Thursday 7 November.
- NO fires are to be lit in the open air from this period, and
- NO fire permits will be issued by Fire Control Officers prior to the commencement date.
Prohibited Burning is scheduled to end 1 February 2025 (Rural zones) and 10 March 2025 (Urban-Rural zone). Please keep up to date if there are any changes to the schedule dates.
